Property issues may be connected with the divorce, but the particular asset, when it was acquired, how it is registered and whether any basis for separate property exists must be assessed.
How is a child’s place of residence decided after separation?
If the parents cannot agree, the child’s residence can become a separate claim considered in light of the child’s interests. Actual care, stability and other relevant evidence are important.
Can I divorce if my spouse is outside Georgia?
In many cases proceedings can still be organised, but jurisdiction, service at the foreign address and representation issues should be checked in advance.
Can the parties settle after court proceedings have started?
Yes. The parties may reach agreement on all or some issues during proceedings. The terms should contain an actual mechanism for performance rather than only general intentions.
